Uber

Uber is the most recognizable rideshare company in the world. Uber’s success has not been without controversy, however.  Since the company’s founding in 2009, Uber has been plagued by consumer lawsuits for a wide range of injuries.

Drivers for the company are covered up to $1 million per accident as long as that driver is at fault while:

  • Their Uber app is on and they are waiting for a passenger request
  • On their way to pick up a passenger.
  • During trip to deliver passenger.

Lyft

Lyft is Uber’s largest domestic competitor. While Lyft has not faced the controversy and scrutiny of Uber, their business model is the same and they are looking to limit liability in litigation using the same arguments.

Lyft also provides a 1 million dollar per accident insurance policy but that policy does not extend to drivers while they are on the app waiting for a passenger request like Uber’s policy

Rideshare Background Checks

The rideshare model also helps rideshare companies skirt certain regulations that are designed to protect consumers. While taxi companies are required to run fingerprint/FBI background checks, Uber and Lyft both use a third party company that runs a less extensive background check that has been often found to be incomplete.

For instance, in Massachusetts, after a law was passed requiring rideshare drivers to submit to state background checks in addition to the rideshare company’s check, the state denied licenses to 8,000 that had passed Uber and Lyfts background checks for offenses ranging from suspended licenses to convictions for violent and sexual crimes. The state of Florida does not require additional background checks.

Florida Rideshare Statute – Florida has enacted a statute to regulate the rideshare industry. In the law, rideshare companies are referred to as “Transportation network companies.” The law covers minimum insurance, background checks, and driver disclosures.
